You agree that the sole and exclusive maximum liability to HWC Enterprises arising from any product sold on the HWC Enterprises site shall be the price of the product ordered. In no event shall HWC Enterprises, its directors, officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to product sold.

Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, HWC Enterprises shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. HWC Enterprises shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, HWC Enterprises shall immediately issue a credit to your credit card account in the amount of the charge.

Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. HWC Enterprises reserves the right at any time after receipt of your order to accept or decline your order for any reason. HWC Enterprises reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $1000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
Sales Taxes
HWC Enterprises shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Texas. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.
Jurisdiction and Venue
You agree that any legal action brought against HWC Enterprises shall be governed by the laws of the State of Texas without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the HWC Enterprises site shall be an appropriate federal or state court located in Corpus Christi, Texas.
Shipping & Truck Deliveries
Most of our trucking carriers offer Curb Side Delivery to customers location. Curbed Side Delivery means it is the responsibility of the customer who is receiving the shipment to have the means to unload by (fork lift or loading dock)
Please note larger items that have free shipping on ground delivery, HWC Enterprises pays the shipping to a Continental US address assuming the location has a fork lift, loading dock or man power to remove the product off the truck. HWC Enterprises does not pay for Residential fees or lift gate service, unless these services were purchased through HWC Enterprises. One of our shipping personal will contact you prior to processing your order with (Residential fees, or liftgate fee if required).
HWC Enterprises offers different options for truck deliveries:
If HWC Enterprises ships to an address (assuming customer has a forklift or loading dock) HWC Enterprises will pay the shipping. If liftgate service is required additional fees will be added depending on the freight carrier. An HWC Enterprises shipping representative will contact you and ask you if you need this additional service. HWC Enterprises is not responsible if the product cannot be unloaded off the truck. Truck drivers are not deemed responsible to help unload the product off the truck.
Trucking carriers sometimes impose additional shipping costs to a residential address. The additional fee is due to shipping carriers not being able to use 18 wheelers down residential streets and need to switch to smaller trucks. HWC Enterprises is not responsible for additional shipping costs to a residential address if this fee is imposed by the trucking carrier.
For larger items that are heavy (over 150 lbs.) customers should request lift gate service.
If the customer does not request lift gate service HWC Enterprises is not responsible if the product cannot be removed from the truck. Please note truck drivers are not deemed responsible to help unload the product off the truck .If the driver or customer cannot unload the product it will be brought back to the shipping depot. The customer is responsible for making a 2nd delivery attempt and will be charged accordingly by the trucking carrier.
Pickup from Terminal:
An alternative to shipping to a residential or commercial/business address is shipping the unit to a shipping terminal. If the customer requests to ship to a terminal we can make arrangements with our shipping carriers for the customer to pickup the unit from the terminal. HWC Enterprises will determine the closest terminal to the customers location prior to processing the order. Please note you must bring proper identification to the terminal for pickup.
Products that have the icon free shipping to 48 states:
Items under 150 lb. that have free shipping on ground delivery will be shipped regular UPS ground or FedEx Ground.
UPS and FedEx:
Most items under 150 pounds ship by UPS or FedEx.
Please note UPS and FedEx cannot ship to a PO Box.
Back Orders:
If an item is purchased from HWC Enterprises that is backordered you will be notified via email immediately. We will keep you updated on the backorder status of the product or we will offer substitute products if the product cannot ship in a timely fashion.
